Agreement
By downloading, installing, or using ProofPack ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App. “Evelaina,” “we,” and “us” mean the publisher of ProofPack. “You” means the person or organization using it.
License
Evelaina grants you a personal or internal-business, non-exclusive, non-transferable, revocable license to use the App on Android devices that you own or control, subject to these Terms and the Google Play Terms of Service. The App is free in its current version. We may change, suspend, or discontinue features in a later version.
What ProofPack does
ProofPack is a local field-evidence tool. It can help you create jobs, capture photographs, record observations, organize report sections, freeze a report revision, and generate a PDF and ZIP handover pack containing selected originals and signed provenance records. It is a documentation and presentation aid, not a court, insurance, accounting, inspection, surveying, construction, or property-management service.
Evidence packs are not guarantees. A ProofPack signature verifies the files and manifest assembled by the App. It does not prove that a photograph is complete or truthful, establish a legally trusted time, identify who operated the device, prove conditions outside the frame, or certify compliance with a law, lease, insurance policy, contract, or professional standard. Confirm important facts independently.
Your content and responsibilities
You retain ownership of the text, photos, documents, and other material you enter or capture (your “Content”). You are responsible for:
- the accuracy, completeness, and lawful use of your Content;
- obtaining consent and any required notice before photographing people, homes, workplaces, documents, or personal property;
- checking the report and its recipients before exporting or sharing it;
- keeping secure backups of packs you need, because local app data can be lost through device failure, clearing app data, or uninstalling the App; and
- using the App only for lawful purposes and in accordance with applicable privacy, recording, copyright, employment, tenancy, and data-protection rules.
Sharing and external copies
The App uses Android's file picker and share sheet only after you ask it to save or share something. Once you select a storage location, recipient, or third-party service, that party's terms and privacy policy apply. Evelaina is not responsible for the recipient's access, copying, retention, security, or onward disclosure of a pack.
Acceptable use
You must not use ProofPack to violate law or another person's rights, to record or distribute material without required consent, to impersonate another person, to interfere with the App or device, or to reverse-engineer, decompile, disassemble, resell, sublicense, or redistribute the App or its code except where applicable law expressly permits it.
Intellectual property
The App's software, design, trademarks, documentation, and implementation are owned by Evelaina or its licensors. These Terms give you a license to use the App; they do not transfer ownership of the App or its intellectual property. Your Content remains yours, subject to the limited technical permission needed for the App to process it on your device and to the recipients you choose.
Privacy
ProofPack is currently local-first and offline. Its privacy practices are described in the ProofPack Privacy Policy, which forms part of these Terms. The current version has no ProofPack account, cloud service, analytics, advertising, tracking, or in-app payments. If that changes, the Privacy Policy and these Terms may be updated.
Age suitability
ProofPack is intended for adults aged 18 and over and is not directed to children or minors. The App does not verify age. If you are under 18, do not use ProofPack.
Disclaimer of warranties
To the maximum extent permitted by law, the App and all generated reports and packs are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted or error-free, that data will never be lost, that a report will satisfy a particular legal or commercial requirement, or that any photograph, timestamp, signature, observation, or generated document will be accurate or accepted by a third party.
Limitation of liability
To the maximum extent permitted by law, Evelaina will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of data, business, revenue, opportunity, property value, coverage, or goodwill arising from use of or reliance on the App, a report, a pack, or an externally shared copy. Nothing in these Terms excludes liability that cannot legally be excluded or limits mandatory consumer rights.
Changes and termination
We may update these Terms when the App, our services, or legal obligations change. The revised version will be posted at evelaina.com/proofpack/terms with a new “Last updated” date. You may stop using the App at any time. The license ends if you breach these Terms; provisions concerning your Content, disclaimers, liability, intellectual property, and interpretation survive termination.
Governing law
These Terms are governed by the laws applicable to Evelaina's principal place of business, except to the extent mandatory consumer-protection law in your country gives you additional rights. Any dispute will be handled by a court with appropriate jurisdiction, subject to those mandatory rights.
