Agreement
By downloading or using Derrick for Android ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.
License
Evelaina grants you a personal, non-exclusive, non-transferable, revocable license to use the App on Android devices you own or control, for your own personal use, subject to these Terms and the Google Play Terms of Service.
Purpose
Derrick is a personal planning tool that takes the rotation schedule you enter and shows you your hitch status, countdowns, upcoming crew-change dates, and pay estimates. It is a convenience aid for organizing your own schedule.
⚠️ Estimates only — confirm with your employer. Derrick's schedules, countdowns, dates, and pay figures are planning estimates generated from the rotation you enter. They are not an authoritative schedule or a paystub. You are responsible for confirming your actual work schedule, crew-change dates, and pay with your employer. Derrick is not liable for missed shifts, missed travel, or pay discrepancies arising from reliance on its estimates. Do not rely on the App as your sole source of truth for when you are on or off — always verify against your employer's official schedule.
Derrick Pro
Derrick Pro is an optional one-time, non-consumable in-app purchase (approximately $29.99 USD; prices may vary by region and current pricing is shown in the App). It permanently unlocks the Pro features on your Google Account. It is not a subscription — there is no recurring charge and nothing to cancel.
- Payment is charged to your Google Account at confirmation of purchase.
- The purchase is tied to your Google Account and can be restored on your devices.
- Purchases and any refunds are handled by Google Play under the Google Play Terms of Service; Evelaina never receives your payment information and does not process refunds directly.
Use of the App
You agree not to:
- Reverse-engineer, decompile, or disassemble the App.
- Use the App for any unlawful purpose, or redistribute or resell the App or its code.
Your Content
You retain ownership of the data you enter. It remains in private local app storage unless you choose to export or share it. Google Play processes purchases and the Billing Library sends its own operational diagnostics to Google. The Android app has no advertising or attribution integration. The Android Privacy Policy explains local storage, billing, reminders, widgets, sharing and deletion.
Tickets, reminders and exports
Ticket entries are text records you enter, not verified credentials. Derrick does not certify their validity or your compliance. Reminder delivery depends on Android notification permission, time settings and battery restrictions. Confirm dates and travel with your employer and the ticket issuer. Exported pay figures and Hitch Log totals are estimates before taxes, not payroll or tax advice.
The free wallet limits adding new tickets to one. Existing records remain viewable, editable and deletable if Pro access ends. Google Play ownership is checked on reconnect; refunded or revoked purchases may remove Pro access. An iOS purchase does not grant Android Pro. Exported and shared copies remain under your control and the recipient's control. Keep your own copies of records you need.
Intellectual Property
The App's design, code, and implementation are owned by Evelaina. You may not copy, modify, or distribute the App itself without written permission.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be error-free or uninterrupted, or that any schedule, date, countdown, or pay estimate it produces will be accurate or match your employer's records.
Limitation of Liability
To the maximum extent permitted by law, Evelaina shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to missed shifts, missed travel, lost wages or pay discrepancies, scheduling errors, or loss of data due to device failure or App deletion.
Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. The revised version will be posted at this URL with a new "Last updated" date.
Governing Law
These Terms are governed by the laws of the jurisdiction in which Evelaina operates, without regard to conflict-of-law principles.
